Maryland offers two options for married couples who no longer wish to live together. A limited divorce is what most people usually think of as a “legal separation” where the spouses remain legally married. When the marriage is dissolved, Maryland law refers to it as an “absolute divorce.” In either case, our experienced attorneys can advise you on relevant legal matters including:

  • Grounds — Unlike other states that have switched to a completely no-fault divorce system, Maryland still requires that grounds be given to dissolve a marriage. Living separately for at least one year can qualify as grounds along with traditional justifications such as adultery and cruel treatment.
  • Property division — When a couple breaks up in Maryland, marital assets and debts are distributed according to the principle of equitable distribution. This does not mean, however, that there will be an even split. Courts look at numerous factors such as the duration of the marriage and each party’s economic situation to reach what they believe is a fair resolution.
  • Alimony — Our attorneys can explain the three types of alimony that a spouse might be eligible for if they lack the ability to support themselves financially. In many cases, the maintenance will only be granted for a limited period to give the recipient time to establish or regain their earning ability.
